If the automobile was acquired during the marriage and/or paid for with community funds (earnings or savings from either of your earnings during the marriage), then it is community property and should be included in your final list of all marital property to be divided approximately equally (considering the equity value in each asset). Once the divorce is filed, neither of you may dispose of, sell, or encumber any assets of the marriage until the final division of property is decided upon. If you sell it in anticipation of filing for divorce, it may also be included (as would be fair) and the reasonable market value minus the amount owed at the time of the sale would be divided.
