Is there a set time I have to wait to remarry if I filed for divorce 3 years ago and is no being finalized by default?

You cannot remarry until you have a document from the court entitled "Notice of Entry of Judgment" which shows the date your divorce is final. If you don't have that, you cannot be sure your divorce is final. It does not happen automatically. Look into it before you remarry.

Apparently you have not filed a proof of service of the complaint for divorce on your soon to be ex spouse.As a non-attorney party you cannot serve him or her and you must use a third party to serve it (such as a commercial process server) if your soon to be ex has not acknowledged he or she received service in process.

Why did the court allowed him in the case. Would filing a complaint with the bar help?

Unfortunately it is at the court's discretion whether a particular lawyer has a conflict of interest and/or should otherwise be recused from representing a certain client. If you are saying that you did file such a motion and even had a hearing on it (which it is your responsibility to schedule such a hearing, it is not automatically granted/scheduled by the clerk) and the judge simply did not rule in your favor, it would likely be a hard burden to try and overturn or appeal that. If you asked for a hearing and didn't get it, or you don't believe you were provided a fair hearing, then that might be worth looking into. You should consult an attorney to discuss further.
