You portray Husband as a serial violator of his fiduciary duties to you as your spouse. You certainly can make claim for these violations, and sue upon it, with or without seeking a legal separation or divorce. You either need to be able already to prove these abuses or you likely would face substantial accountant and attorney fees to find and develop whatever evidence exists. Perhaps you should get Husband evaluated for need for a conservatorship or, at least, someone exercising rights under an estate plan (e.g., powers of attorney, living trust) who hopefully would better honor Husband's fiduciary obligations to you. This fiduciary could look into past abuses if you wish and certainly should avoid future abuses.
