The answer to your question is, "yes", if you are legally separated (as opposed to having the marriage "dissolved"), you may stay on his health insurance policy. You can also proceed with a Judgment of Dissolution but defer the date that the marital status terminates. If the marriage is terminated, you will have to apply for COBRA benefits which are guaranteed to you for 36 months. You would have to bear the cost of the premium and this cost would be a need" for you which would factor into your request for spousal support.

You are still married. Child support modification is probably appropriate if he now has two children to support. The divorce can be finalized at any time and, if your husband wants, he can have the judgment from that case entered nunc pro tunc (Latin for: "now for then") so that his current marriage will be valid from its inception by operation of law.

Either spouse is entitled to a divorce if they want one, on any grounds they have, they only have to claim there are irreconcilable difference (they do not need to detail those differences). Your spouse was not entitled to "kick you out" of your home. Both spouses are entitled to remain in their home during a divorce unless and until a court orders otherwise. You are entitled to a fair division of Assets and Debts, if you have children, you may be entitled to Child Support. The lesser earning spouse may be entitled to Spousal Support.
