Would I still get a divorce if my husband denies he was served?

Answered by attorney Derek Layne Hall (Unclaimed Profile)
Divorce lawyer at Derek L. Hall, PLLC
If you hired a process server to serve him, the process server should have given you a summons return, notarized, to be filed with the court. If that procedure is followed and your husband is denying that he has been served, then you can call the process server as a witness and have him/her testify. If you did not use a process server and you attempted to serve him yourself, save yourself future headaches by hiring a process server and have him reserved.

Why do I get a request to enter default from the court after signing divorce papers?

default-avatar
Answered by attorney Swati Sumit Desai (Unclaimed Profile)
Divorce lawyer at Desai Camino, APC
When you are served with divorce papers, you must file a Response within 30 days. If there is no Response on file, then the other side can enter a request for default at any time after the 30 day period and before a Response is actually filed. You should file a motion to set aside the default if you cannot reach a complete agreement because the court will proceed without you. Motions must be filed timely.

Do we have to go through our attorneys and courts to make it legal or can we just sign it and have it notarized to make it legal?

Post nuptial agreements require careful drafting. You want it to be enforceable. If you do it yourselves you risk the court not enforcing it. The law changes and you need to anticipate the problems.
