You must still first apply to remove your conditional status. If it is denied, then you could pursue the new marriage case.

Is there a time limit on getting married before the deportation hearing

Answered by attorney David Troy Cox
Immigration lawyer at CoxEsq, PC
If a Notice to Appear has been issued (and it has, or you wouldn't have a hearing date), the person is already considered "in proceedings".  Proving the bona fides of a marriage entered into with someone in proceedings is more difficult because there is a higher standard of proof on the issue of whether the marriage was entered into in good faith.  Getting marriage before proceedings would have been best, but it is already too late for that.  The hearing date itself is irrelevant for purposes of determining whether the higher standard applies.
