Dear Manuel,   How old are you?  Are you a Lawful Permanent Resident?   The English language requirement does not apply if: A)  You've been a Lawful Permanent Resident for at least 20 years and are over the age of 50 OR B)  You've been a Lawful Permanent Resident for at least 15 years and are over the age of 55. You would also be given special consideration in the civics and history test if you have been a Lawful Permanent Resident for at least 20 years and are over the age of 65 years old.  You would only have to study 25 civics questions in your language and would only need to get 6 out of 10 correctly. You could also get a Medical Disability Waiver.  You would definitely need the services of an Immigration Attorney for the Medical Disability Waiver.  If your Medical Disability Waiver is approved, you would not have to take any test.

CIS has not started the new procedure, which allows the applicant to file the waiver in the United States. You should file the visa?petition?first and then when CIS starts to accept the waiver application before the alien leaves the US, file the waiver application. Please note that the substantive law has not been changed. Whether your husband can get the waiver is still uncertain and you should retain the service of immigration lawyer to assist you in the waiver application.
