Alan Rodolfo Diamante
Answered by attorney Alan Rodolfo Diamante (Unclaimed Profile)

If you entered the U.S. unlawfully and were never a beneficiary of a family petition or labor certification, you will have to leave the country and apply for consular process if you marry a United States citizen. When you consult with an attorney, he needs to know many things to properly analyze your case.

Foreign MD with daughter in California: what is the best option to get visa/ green card?

If your daughter is a US citizen and at least 21 years of age, the best option for you to get your green card is to have your daughter petition for you on form I-130. Since you were never married to her mother, did you legitimize your daughter before she turned 16 years of age?
