Petition to take about 6-8 months to be approved. However, if you are a US resident it will take about 3 years for your kids visa to be current for them to immigrate. If you are a US citizen and your kids are under 21, they can immigrate soon after the I130 is approved and the national visa processing center is completed.

Unfortunately you have only one year from the date you last entered the U.S. to file for asylum. Unless there are changed circumstances, either in your home country or with yourself, that meets the exception to the one year rule, you will not be able to qualify for asylum.

Whether he can come back as a fiance or spouse depends on whether he accrued unlawful presence in the U.S. Six months out of status after 18 years and a subsequent departure will result in a three-year bar from the U.S. Unlawful presence of a year followed by a departure will result in a ten year bar.
