Do I need to change my green card status if I got married?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
If you have changed your name it is recommended to get a new PR card and new passport in your married name. If you are eligible for citizenship soon you may want to wait and take care of this as part of that process.

Will my green card petion be affect if I get married?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As your mother is petitioning for you under the F-1 category as the son or daughter over the age of 21 (assumedly) and you are still waiting, I will also assume that your priority date has not yet been reached. If you marry within the time that you have not yet received the green card, your mother’s petition would change in category to F-3 as the married son or daughter of a U. S. citizen. You would likely have to wait at least another 4 years to immigrate. For most countries of the world, the F-1 preference has availability in June 2014 for those who filed before March 22, 2007. F-3 availability is for those who filed before October 1, 2003. Certain states allow gay marriage, however, Texas and Florida are not included. The immigration service recognizes gay marriage in all 50 states, for purposes of immigration benefits.
