Hello. His visa does not control his authorized stay. It would be the I-94 that was issue to him (or online) that determined his dates he was legally here. If he overstayed 6 months and left, he will be barred for 3 years(10 years if he stayed overstayed a year).   What type of visa was it? When did you not process for the green card in the US?

Hello, Generally, if your spouse entered the US illegally and you did not file the I-130 family visa petition before April 30, 2001, then you would not be able to file for the I-485 in the US. You would only be able to get their green card by going abroad to a US consulate along with the provisional waiver. I would suggest that you go and speak to an attorney in your local city and provide them with your details to see if you have any other choices based on your background and personal history.
