Shall my wife apply for citizenship naturalization after a shoplifting charge?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The answer depends upon your wife's tolerance for rejection. A denial would not prevent her from filing in December 2021. There is a chance that she may be denied as the question of good moral character is discretionary and may depend upon the interviewing officer. She has a good argument to make if it can be shown that the postpartum depression was a large factor in the shoplifting incident. However, she should be prepared to take the risk of rejection if she decides to go forward. Can I apply for citizenship if I am a green card holder for over 21 years?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
Your facts are confusing. Eligibility for citizenship has several requirements. ONe is being a permanent resident for five years, and you have that. Another is physical presence in the U.S., and it seems this may be a problem for you.

How can I help my mother become a U.S. citizen or a permanent resident?

Answered by attorney Carlos E. Sandoval
Immigration lawyer at Carlos E. Sandoval, P.A.
We would need to check whether your parents qualify under section 245(i) of the immigration laws. Has anybody ever petitioned for her or your step father?
