Will marriage stop my boyfriend from being deported?

Pablo Husayn Nossa
Answered by attorney Pablo Husayn Nossa (Unclaimed Profile)
Immigration lawyer at Nossa Law Office, P.C.
It depends on a number of factors including, how he entered the US initially, when he entered the US, the type of crime he may be convicted of and what your immigration status is. I would recommend contacting an experienced immigration attorney to discuss what if any relief is available.

What question will they ask you at the interview to remove condition of your green card?

Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
At the interview to remove conditions on your residency status, USCIS can pretty much ask any question they need to prove that you were married in good faith. In that regard, they will usually ask questions as to how your relationship was established, what has happened since your marriage, and what your intentions or plans are for the future. You will also be asked to submit documentation of your marriage too.

Why does my I485 goes back to review after the interview?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)

It is common for USCIS to review the file after the initial interview, because they want to make sure that nothing was overlooked before approving the file. The fact that you were separated during the interview is an indication that the adjudicating officer has concerns about the bona fides of your relationship. They can approve the application as is or they can schedule subsequent interviews until they have enough evidence to make a decision. In situations where they suspect marriage fraud, they will mail you a Notice of Intent to Deny and give you up to 30 days to submit additional evidence to overcome their suspicions.
