If my parents came to the US illegally back in 1993, could I put in a petition for them?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
You can file an immigrant petition for your parents, and it should be approved. The problem is that your parents are inadmissible for 10 years (possibly, longer). It means that they cannot get green cards without leaving the U.S. and living in their native country until the period of inadmissibility passes. The government can waive this punishment if your parents can show that their banishment would cause *exceptional *hardship to their children. Proving such hardship is not easy, and depends on many factors, including the children's ages, health, academic performance and aspirations, and more. USCIS will look at all of your family circumstances and decide whether to permit your parents to adjust status (get green cards) or to deport them, saying that the children can go with the parents and come back to he U.S. as birthright citizens after they reach 21 year of age. A competent immigration attorney can evaluate your parents' case and give you an advice based on your family's circumstances.

I am an American citizen, how long will it take for my spouse to get residence?

Presuming you are the petitioner for your spouse for an immigration petition based upon marriage, the processing time generally takes between 3 - 6 months, from the time the initial application is submitted through fingerprinting, final interview, and issuance of the permanent resident card.

What is the process of re-applying for U.S citizenship?

Samuel Joseph Zermeno
Answered by attorney Samuel Joseph Zermeno (Unclaimed Profile)
Immigration lawyer at Zermeno Law
Hello. When a person is found to give misleading information they are barred from recieving immigration benefits unless a waiver is approved. In your case, if you never willfully or knowingly gave misleading information you may still be able to naturalize. Given the complexities of this process it is best to retain an experienced attorney to best guide you through this process. Please call me for a free consultation to determine if you can still apply for citizenship without any waiver.
