It is up to you but if you do not speak with the attorney first you may be in a situation where you are married but your spouse does not qualify to remain in the US.

How easy is it to reschedule oath ceremony? Can we mention unavailable dates after interview?

Answered by attorney Alena Shautsova
Immigration lawyer at Law Offices of Alena Shautsova
It should not be difficult, but I do not recommend doing that. Also, I do not really think that giving the dates when you are not available is going to help much, but you should of course mention them.

You will need to meet with an attorney with detailed information about the arrest. It will depend on the state criminal statute.
