Emigrate to the United States

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An initial question would be whether you or your wife are able to receive job offers in your respective fields. If you are able to do so, and if you both have the equivalent of US baccalaureate degrees either through equivalent degrees or a combination of education and working experience, you may be able to obtain working visas under the E-3 visa for Australians. You can also at a later point be sponsored for permanent residence through the labor certification process which would depend upon the wishes of your employer. If you do not have a job offer from a US employer, you may be able to establish your own business in the US and live here for many years through an E-2 investor visa which, while not a permanent resident visa, is a long term one under which you would be allowed to continually work in your own investment.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Do I have to submit a lease to prove I am living with my wife for a green card?

Answered by attorney Jeffrey N Lisnow (Unclaimed Profile)

To prove a case involves a lot, not just a lease. You would do yourself a huge favor by investing in a consultation with an experienced Immigration Attorney who can review all of your documents. If your case gets denied you may face very serious consequences as well as huge expenses.

How long does it take to petition an African husband?

Answered by attorney Larry F Chin (Unclaimed Profile)
Immigration lawyer at Julian & Chin, LLP
If you are a US Citizen, the process typically takes one year. The hurdle for your boyfriend is whether the US Consulate in Ciudad Juarez will agree to process his case. Typically, the State Department will only process visas for citizen and nationals of the country where the post is located.
