Can my 11 year old daughter and I get our green card if my wife of 4 years refuses to file for us now we finally decide to move to the U.S?

Answered by attorney Giselle Ayala Mateus
Immigration lawyer at G.A.M. Law Office P.C.
You and you daughter may apply for a green card under VAWA. It is a petiiton that may be filed by either man or woman. You will need to be a position to prove the reality of the marrriage. You can but don't have to divorce her too.

Can I get married to my fiance who's a green card holder with my business visa and stay in US?

Answered by attorney Richard Stephan Kolomejec (Unclaimed Profile)
Immigration lawyer at Richard S. Kolomejec
If you overstay, you can only get a green card through a marriage to a US citizen. So you will wait until your fiance becomes a US citizen to apply for permanent residency in the US.

Can ICE put an immigration hold on a known US citizen?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
Something is wrong with this picture: ICE has neither the power nor a reason to detain a U.S. citizen. If you or your boyfriend's family have documents proving that he is a U.S. citizen, any competent immigration attorney should be able to get him released from the ICE custody rather fast.
