Whether charges will be dropped or not, will be up to the D.A. and jail time is always a possibility. Another problem arising from a domestic battery charge is the possibility that you may be arrested by ICE and place in removal/deportation proceedings. I strongly suggest that you contact an experienced immigration and criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. (S)he would then be in a better position to analyze your case and advise you of your options. You should not use the services of the Public Defender's Office, since it has been my experience that very few Public Defenders are aware of the immigration consequences of criminal charges.

Most H-1B's will qualify for permanent residence under the EB third preference. It takes about 6 months for the labor certification and then there is a 6 year backlog (for most countries) for the priority date to be current to allow for the application for permanent residence. If you marry an LPR, it generally takes about three years for the priority date to be current to file for permanent residence. Please note that if you apply through your LPR spouse, you must maintain your nonimmigrant visa status (for example H-1B) until the FB priority date is current and you actually file.
