When will I get my green card?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
After you enter the U.S. and advise them of your address, the CBP officer will collect the packets you got at the consulate and mail these to USCIS. Shortly thereafter you will each receive a Welcome Notice and your PR cards will be mailed to you. The Social Security numbers have already been requested if the paperwork was completed properly; but it doesn't hurt to check on this after you arrive. Note the validity date on the Immigrant Visas and make sure you enter the U.S. before that date.

How can a petty theft affect citizenship?

You need to consult an immigration attorney: depending on quite a few details, it might be OK for her to apply for citizenship in 2013, it might be better to wait a few years, or she might just have to forget about naturalization.

Should I file for green card with USCIS or wait for the court date?

Answered by attorney Myron Russell Morales (Unclaimed Profile)
Immigration lawyer at Quan Law Group, PLLC
Since the NTA has not yet been filed with the court, you can file the I-485. If it is approved before the NTA is filed, then you can do a motion to terminate in the Immigration Court. If the NTA is filed while the I-485 is pending, then you can either ask ICE to withdraw or ask USCIS to put the petition on hold while you get permission from the Immigration Judge to seek permanent residence. The risk is that you may have to pay the I-485 fee twice. Get some advice from an attorney before you act.
