You can submit a fiance petition for your 3rd cousin as long as it is legal to marry your cousin in the jurisdiction in which you live. If you are unable to meet the minimum financial requirements for sponsor, you will need find a joint sponsor who is willing to assist you in that regard.

In regards to unlawful presence as it applies to the 3-year and 10-year bars under INA 212(a)(9)(B)(I) & (II), you do not need to file a waiver for unlawful presence as long as you departed the United States within 6 months after your 18th birthday.

Can I file my I-485 when my priority date is earlier than the current visa bulletin date while my I130 is still pending?

Answered by attorney Lelia Adams
Immigration lawyer at Essien Immigration Law, PLLC
It is always faster filing for a spouse as a U.S. citizen so I will ask how long have you had your Green Card? Are you almost at the point where you could file for Citizenship? Generally an I-130 needs to be approved first and your priority date needs to be current before I-485 can be adjudicated - I recommend you seek assistance from a licensed attorney in order to prevent delays.
