Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. First of all, since we do not have all the facts, it is not really possible to answer with complete accuracy. How old were you when you were convicted? Were you convicted in Juvenile or Adult Court? What was the exact charge that you were convicted of? Is your spouse a U.S. citizen? I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options. Also, be sure to bring any records or documents you have pertaining to your criminal history for the attorney to review.

As a permanent resident, your spouse is a second preference visa classification (FB-2A) and that is backlogged approximately four years. You can check the US Department of State website and check the visa bulletin, which is published monthly. It will list the current priority dates for that preference classification. There is no process to expedite the visa availability or issuance.
