Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
What was he arrested for? Did he enter a plea in the criminal court? If yes, to what charges? When and how did he come to the U.S.? What is his immigration status now? Does he have any orders of removal (i.e., for deportation) against him? Does he have any criminal history before this arrest? I would ask you another dozen questions before I could answer yours. In this kind of cases, there is no time to waste. If this man is dear to you, get an attorney immediately. Ideally, it should be an attorney who does criminal defense *and*immigration law. If you cannot find such a specialist, consult an immigration attorney first.

Will my I-360 get approved when I have two years green based on the marriage?

Answered by attorney Larry F Chin (Unclaimed Profile)
Immigration lawyer at Julian & Chin, LLP
If you already have your green card, then you will have to file form I-751 not form I-360. You will have to get a divorce prior to the final adjudication of the I-751. You can seek waiver of the joint filing requirement on account of the abuse inflicted upon you by your wife.

How do we get a fiancee visa?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
You must have proof that you met her to the satisfaction of the USCIS. The fiance visa process with both USCIS and State Department processing can take nearly a year. It can also get complicated at times depending upon the facts. Immigration law is civil law, so violations and grounds to bar admission require less than criminal conviction and merely acts that the consular officials reasonably believe disqualify. There is little review once a consular official makes an adverse decision.
