You should contact an attorney to prepare and file the case for you. That is the best way to alleviate any problems for if the case is filed erroneously and gets denied your mother can wind up in removal proceedings before the Immigration Court.

A denied K-1 visa at the U.S.Consulate in the Dominican Republic is not likely to turn into an approval, and waiting could take years. Your suggestion of getting married and starting all over with an I-130 is not a bad idea. On the other hand, it's no guarantee they won't re-deny for the same ridiculous reason. And, should you choose to hire a lawyer, our law firm is happy to represent in these types of cases.

I would recommend not getting married until after you become a US citizen (and after he enters the US). Then wait a couple of months before getting married. I can prepare the forms, file the paperwork and represent you guys at the interview. Entire process only takes about 3 months.
