Would it benefit me to hire an attorney or do I already have enough bills coming in as it is?

When you are charged with a DUI, your drivers license is set for automatic suspension 29 days later unless you demand a hearing in writing within 10 days of arrest. So, you didn't do that and your license got suspended for the per se arrest, and now you have even more trouble. Maybe a lawyer can help straighten things.

Is it good that DUI charges are not filed yet after I was arrested on 7 July and appeared to court on 3 October?

Neither. You'll get a letter in the mail from the court telling you a court date to appear, once the charges are filed. They have a year to do so. If you hear nothing, check with the court clerk or DA office every month or so, to make sure you didn't just miss the letter. Once charges are filed, if serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. I'll be happy to help fight this and get the best outcome possible, using whatever defenses there may be. Unless you have already done so, it is too late for you to file a request with DMV for a hearing on an appeal of the automatic suspension of license imposed by DMV upon arrest.

Do I have a good case for pleading not guilty since I was not operating my car and was a half mile away when arrested?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
Well, maybe. First, you don't need a good or bad case for pleading Not Guilty. You are entitled to enter such a plea if you want to do so. As to prevailing in court, you should consult an experienced criminal or OWI lawyer, who can review the facts in much greater detail than can be done on this ste. Good Luck.
