If the police feel that they have enough evidence, and sometimes even if they don't, they can arrest you. This is true even if you have an attorney. Invoking your 5th Amendment rights and refusing to answer any questions is the best thing you can do.

If you are charged with a new crime while on probation, then it is likely that you will be facing a stiff sanction, which can include jail. You may also be looking at jail/prison with charges stemming from this new incident. I would recommend he gets an attorney immediately so they can begin to prepare his defense as a lot is hanging in the balance with this new charge.
