Can I own a gun in California if I was arrested for theft and my attorney got me a diversion?

Read your plea and sentencing paperwork to see if it included a firearms prohibition. Other than that, you would be a prohibited person barred for life from ever possessing firearms if you are convicted of any felony, are subjected to any domestic violence restraining order, or are committed to any facility for psychiatric reasons.

If the police didn't arrest for the assault, I don't think there is much of a case civilly. Wasn't there a video in the store that could show what happened?

Yes. Did you try contacting his Parole Agent and informing him that he cannot live at that address, and that there is already another parolee living there?
