You need to file a petition for divorce. The petition can be served directly upon your husband. If he cannot be located, he can be served by publication.

It's not an emergency issue, but you can file a request for orders for spousal support. You should get a court date in about 6 weeks, if you need to do any discovery or get any subpoenas to show his income, you will need to get on it immediately in order to have the information before your court date. An attorney would make this process much easier, and you can also request that your husband pay for a portion (or all) of your attorney fees. After such a long term marriage, and with you being a stay at home mom, so long as he has an income capable of paying for both your attorney fees and his own, you would likely be granted this request. Have your assets and debts been divided yet? This is also something you will need to address.

She cannot take everything, you each own 50%. However, the court may want to grant her a greater portion because of your threats to do her harm. Don't belittle what you did. A gun in an argument is a threat and she was scared. If you have not done it, you need to get counseling to address those issues.
