Regardless of where spouses were married, in California, the earliest time a judgment for dissolution (divorce) may be entered is six months from the time the petition and summons are served on the other spouse. Note, however that the six month period is only an estimate. In reality, the divorce process may take a longer time depending on factors such as the complexity of the issues involved and how cooperative the spouses are. To file for a divorce in California, you or your spouse must have lived in California for at least six (6) months and in the county where you will file the application for at least three(3) months. In general, Philippine law does not provide for divorce. The exception to this is for Muslims in the Philippines The Code of Muslim Personal Laws of the Philippines, allows spouses to divorce when 1) both are members of the Muslim faith or 2) when the male is a Muslim and the marriage is solemnized anywhere in the Philippines in accordance with Muslim law.

As long as the court did not terminate jurisdiction over the issue of the spousal support, then you have a right to request it. The length of your marriage is an important factor. You should have the divorce judgment reviewed by an attorney in the State where the divorce was entered.

If he isn't getting a pay check or unemployment, you have nothing to attach your wage assignment to so that you can get your payments directly from his employer. If he has money in a bank account, you can have your arrears determined and attach his bank account (if you believe that he has enough money in the bank to make sure this process worthwhile).
