Does my wife have to pay me alimony and child support if I have the kids more than her?

Answered by attorney Loren Paul Zahn (Unclaimed Profile)

Based upon your respective incomes, you should definitely receive spousal support. As for child support, it isn't possible to answer that without knowing the custodial schedule, but you likely would also receive child support. Both child and spousal support are gender neutral.

What does the order mean?

Divorce lawyer at Utah Family Law LC
The way I read the sentence that you have quoted, it provides that if you and your husband reconcile within the "period of suspension" (whatever period that may be), and then no motion to dismiss divorce action or "further proceeding" (whatever that means) is filed within 30 days after the "period of suspension" expires, then the divorce action will be dismissed. However, the next sentence states that if the parties do not reconcile within the period of suspension, the action shall proceed. Those are two terribly drafted sentences. They are needlessly wordy and clumsily constructed, and as a result extremely difficult to understand. It is likely clear to you and your husband that you and he agree, even though the wording of your written agreement is far from clear, that you will try to reconcile during a "period of suspension" and that if you do not reconcile in that time period the divorce action will proceed. My guess is that is what you and your husband intended, but that is not what you're agreement states. The best thing to do would be to rescind the existing agreement and replace it with a rewritten, clear agreement that suffers from no ambiguities.

Does it cost much to look over my paperwork and can I have an estimate?

If the paperwork is not correct, DO NOT SIGN IT! You could be giving up valuable rights. Many attorneys offer a free initial consultation, during which they could possibly look over the papers and advise you accordingly. You need to consult with an attorney before agreeing to anything.
