What are my rights if I’m not legally separated?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
In Idaho, you probably own half the house, even if only his name is on it. Even if you don't own half the house, you can probably get the judge to allow you to stay there for a good period of time until the issue can be worked out.

What will happen if my husband filed for custody when I already have custody in another state?

If he is here with the children and it has been over 6 months, then he can file for custody here. If it is not at least 6 months and 1 day you need to contact a lawyer to respond in this state to deny jurisdiction.

Does my ex husband have to share my in-laws inheritance?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)
Divorce lawyer at Havens Law, LLC
Your husband's inheritance MAY be divided. It is up to the discretion of the Court whether it awards inheritance property under equitable principles. The likelihood of you getting any proceeds increases as the interest in the inheritance gets treated as commingled property, you've maintained, augmented, or protected that interest. Also, a Court may award some or all of the inheritance as an off-set to Alimony or in lieu of another issue pertaining to your divorce. The longer the marriage the better, 20 yrs. is a long marriage. You obviously increase your chances by persuading the judge to exercise its discretion in your favor, which requires skill and experience.
