Good question, and the answer may surprise you. In my professional opinion, if you and your wife stayed in your settlement agreement papers that you and she have made a full disclosure of your assets, when in fact you really haven't, your divorce action can be reopened for the purpose of dividing those undisclosed assets, and it's not unusual for a court to punish the party that concealed the assets by awarding a substantial chunk, if not all of the asset, to the innocent spouse. When you ask whether you're required to identify your 401(k) as part of the divorce settlement, you already know the answer. The answer to such a question lies in the asking. I can understand if you don't want to share your 401(k) with her spouse. Frankly, under certain circumstances, there are some good arguments as to why one should not have to share one's 401(k), but keeping your 401(k) secret and hidden is not the way to go about it. Otherwise stated, concealing your 401(k) is one of the best ways to ensure that you are divested of that asset in divorce.

If you are no longer in prison, revoke the POA. As for abusing it, maybe. But if it is in the best interest of your child, I am not sure the court will care a lot.
