You cannot just stop paying without a court order. You must file a motion to modify/terminate spousal support based on the change of circumstances of the reduction in your income and that each of you will be receiving the same amount of income. Motion will have to be filed when the change has occurred or is very close to occurring.

If you were not awarded a portion of his pension when you got divorced, I do not believe that you are entitled to any of it. In the divorce, the court would have issues a qualified domestic relations order that would have split the pension. Talk with your attorney to see what happened.

Basically the fact that your husband is in jail doesn't prevent you from obtaining a divorce exactly the same way you would if he were not in jail. You file the Petition and arrange to have him personally served the paperwork. Then, you proceed with all of the procedural requirements exactly the same as if he were living next door. Obviously, being confined make his participation in the case more difficult, but in today's world of technology he can participate in any court proceedings by telephone, if necessary.
