You can file in the state you are a resident of at the time you seek a divorce. In California, the requirement is that you be a resident of the State of California for six months before filing for divorce, and a resident of the County in which you file for at least 3 months. Even if you don't meet the residency requirement, a work around is possible that will allow you to file now.

If he fails to appear, he could be held in contempt of court and jailed. He cannot get the subpoena reversed. But he can call the attorney's office and tell them that he has no relevant knowledge about the case.

If you have proof of all the monies your father gave you and if all of the proceeds from the house went to your father to repay the loan, then your Husband shouldn't have any claim to those funds. However, ultimately it would be up to a judge, so you should have an attorney represent you so that evidence can be properly presented to the Judge.
