Assuming that you have no minor children together, and that you have truly divided up all of your stuff, then generally, there should be nothing preventing you from getting divorced. You should generally be able to file a simplified dissolution of marriage action, serve your spouse, and obtain a divorce.

You have a short term marriage and might be able to get some form of alimony. The big problem is that it might cost you more to hire an attorney to fight for alimony than you will be able to get, but it depends upon all of the facts and a complete review of the financial circumstances to be able to say much about it.

  Moving out of the marital home doees not necesarily mean that your wife will receive any more or any less in a divorce.  However, at this point, both father and morhter have equal rights to the children, so if she denies you access to your children, it could work against her in the ultimate decision as to timesharing with the children.   If the marriage is over, which it appears to be from the limited facts you have supplied, then it is time to take legal action, file for divorce, and get your property rights, timesharing and parenting plan and child support established.
