Do I need my marriage certificate to get an annulment?

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
Although you do not need your marriage certificate to get an annulment, you still have to obtain service of process on the other party.  Further, it is likely more difficult to get an annulment than to get a divorce under your circumstances. You must prove the marriage is voidable (no consummation).  I've never had this situation where the other party (I assume) cannot be personally served. On the other hand, if you merely file for divorce (because there are no children "of the marriage"), and you do not know where to serve your wife, you can serve her by publication, after preparing an affidavit stating you made a diligent search to find her but you could not,  and since there is no property to divide, you will not have the same burden of proof to get a divorce as to get an annulment. You should consult with an attorney to weigh your options before proceeding. Best of luck, Cindy S. Vova Law Office of Cindy S. Let your attorney proceed with the divorce. He will do what he has to do until your husband either caves or the judge issues a ruling.
