My husband is retired military,he said when he divorced his ex wife the judge ordered him to leave her on his retirement as spouse and as his benefic

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
Typically if a assets (which your husband's military pension is) is  distributed in a divorce as what we call equitable distribution, that cannot later be changed.    It is possible that the ex did not get 100%, or perhaps was to get 100% of the amount that had accrued at the time of the divorce,  and there may still be additional benefits that your husband would receive or that he could leave to a beneficiary.     You should have an attorney review the actual final judgment of dissolution and then contact the administrator of his military benefits who may be able to help you.   Best of luck, Cindy Vova Law Office of Cindy S. How am I going to have my pension not disclosed?

default-avatar
Answered by attorney Julie Anne Ringquist (Unclaimed Profile)
Divorce lawyer at Law Office of Julie A. Ringquist
You have no other options if you wish to receive your portion of the Pension. You will need another court order to receive your part of this undisclosed asset. You may also request attorney fees and sanctions for his failure to disclose the asset, so that you do not have to pay for his non-disclosure by incurring additional court and attorney fees.

Will a man still be responsible for a child support even if it's not his?

Peter David Ticktin
Answered by attorney Peter David Ticktin (Unclaimed Profile)
Divorce lawyer at The Ticktin Law Group
Probably not. If there was not yet a child support order in place prior to the DNA test, the Court will not likely issue one now. If there was a child support order already in place, and your husband has now learned that he is not the father by virtue of the DNA test, he would have good grounds to petition the court to disestablish paternity and terminate child support.
