A lawyer can appear for you, but it is a trial, you will need to be there to testify. Costs among attorneys varies and how complicated the case is will have an impact on price. Call the State Bar of Idaho and they can refer you to counsel who can represent you.

Rights to the home in a divorce proceeding

You do not have to stay in the home to have rights of ownership. As an example, you could own a rental property, but you don't live in the property.  You still own the property, even though you don't live there. The same applies to the marital home. If the house was bought during the marriage, or has your name on the deed/mortgage, then you  have certain rights to the house whether you live in it or not.  One problem that can arise, your spouse remains in the home, and fails to pay the mortgage then the lender forecloses.  Another potential problem is that your spouse goes to court, tells the court you moved out and asks for exclusive use and possession of the home. In the current real estate market, some homes are not sold for years if ever. Your spouse could remaining living in the home that you own for many years, to your exclusion. You still own it but cannot occupy the home and cant sell it either.

Filing fees depend on the County you are in, around $450. If you mediate, you can probably do your divorce for around $3,500. It will take at least 6 months from the date the other side was served or responded.
