My husband bought a couple of houses a couple of years ago and I'm wanting to move into one without him do I have any rights to the house?

default-avatar
Answered by attorney Rian F. Ankerholz (Unclaimed Profile)
Divorce lawyer at Ankerholz & Smith
There are too many factors involved in your situation to be able to formulate a reasonably certain opinion as to what will happen to the houses. A judge will look at many factors, including, but not limited to whether any non-marital funds were used to purchase the houses, and whether you can afford to refinance the house to get husband's name off of the mortgage, if any.

Is it unlawful to pay someone’s mortgage without asking them or them knowing?

Answered by attorney James T Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
It does not matter who paid off the house or why. Your Ex spouse is subject to a Court order. What does the judgment of divorce say about him living in the house? If nothing you might be able to treat him as a tenant and give him a 30 day notice to quit and then file sue him to evict him as if you are his landlord (which you are). The question is whether the daughter is a minor and if he has custody you might not be able to kick him out then.

Will I lose my alimony?

Answered by attorney Cindy S. Vova
Divorce lawyer at Law Offices of Cindy S. Vova, P.A.
It sounds like you have an agreement to receive lump sum alimony, which does not terminate upon remarriage.  Further, since you say there is specific langauge addressing that alimony does not terminate when you remarry, then your ex is probably just trying to scare you.  However, without reading the entire agreement I cannot give you a definite answer as there is always the possibility that another part of the agreement may change my opinion.    As to the alimony, if the agreement says the 1st, then its the 1st.  The problem is you would have to take your ex to court and file a motion to compel enforcement/ motion for contempt to have the provision enforced.  You could ask for an Income Withholding Order, whereby the alimony would be deducted directly from your ex's pay and sent to you or the state depository.      Best of luck.
