In order to answer this question any attorney will need to read the agreement, if there is one, and the final judgment. If the pension was equitably divided as part of the divorce, you probably will not lose the pension benefits.

You file in the state where you last resided as husband and wife. Yes, you have to get her served, or at least try, and then perhaps after a diligent search and inquiry as to where she is, you might be able to publish in the paper.
