Is a retirement account always split up during divorce?

The court divides all assets and debts but depending on what your spouse gets, it may balance out the retirement so it doesn't have to be technically divided.

Do I have to change my filing status if I plan to get divorced?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
Until your status is legally changed by the court you are married. You may file married and separate or married and jointly with your spouse. You can file for divorce anytime as long as you meet the residency requirements, lived in the state of California for 6 months and in the county for 3 months prior to filing. If the children live with you the court will determine the amount of child support. You should consult a family law attorney to understand your rights. If you cannot afford an attorney, most county's provide free legal assistance and you can file without the help of an attorney.

Can my ex wife receive compensation for community assets?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
Community payments to improve or maintain separate property. If a spouse brings a separate property house into a marriage, and then uses his or her monthly salary to pay the mortgage, the courts will determine that part of the house has become community property. The percentage of the community interest will depend on the number of mortgage payments, and how much the value of the house changed during that period. Likewise, using community assets to pay property taxes, insurance, and repairs can also give the community a claim to part of the house.
