Merely filing for divorce does not result in automatic deportation. Divorced or not, if your husband is in this country illegally, he is subject to possible deportation. You've been supporting his addiction for years. Time to move on with your life. Yes you may have to pay alimony. The court will order him to make job contacts if you file your motion and maybe you'll have to do a vocational evaluation on him but at least you won't be liable for accidents caused by him drinking and driving. The extra years you stayed meant extra time you may be paying alimony. Staying longer only gives him more rights to your hard earned money.

If you are in Colorado, no-fault divorce law means that there is nothing your husband can do legally to prevent you from asking for and getting a divorce. You should contact an attorney for at least an initial consultation to educate you about the general legal principles that will be followed if your husband is not willing to work out an equitable financial settlement and parenting plan.
