Consent Divorce and Defendant's absence on the testimony

Answered by attorney Gilbert Borman
Divorce lawyer at Borman-Lahti PLLC
I am pretty sure he has to show up.   They court will want to ask both of you in court if the proposed judgment is what you both want. No way around it.

How can I find out if I am still married or divorced?

Answered by attorney Madanmohan Singh Ahluwalia
Divorce lawyer at Ahluwalia Law Professional Corporation
You can go to local courthouse or to the courthouse where your spouse lives and check court records. Divorce requires notice. You would not end up getting a divorce without notice (unless you moved across the state, or were away from last known address for long period of time or were in coma).

How will his filing bankruptcy affect my home?

default-avatar
Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
See an attorney but generally his liability to the CREDITORS, including the bank on the mortgage could be extinguished by his bankruptcy leaving you the sole remaining debtor on what were joint liabilities. However, even after the bankruptcy he may be liable to you under the divorce judgment for the damages caused to you if hi did not pay his obligations under it. Call for an appointment, exposition of the fact and firm advice.
