Is there a certain amount of time you have to be separated from your spouse to be considered legally divorced without going to court?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
Under Texas law you are either married or not. Separation does not give you a divorce, only a court order grants a divorce. If there was no formal marriage (common law marriage or informal marriage) then the rules a different. If the parties separate and there is no suit for divorce filed within a certain period of time, there is a presumption that there was no informal marriage. I suggest you hire a lawyer to discuss the facts of your case.

Is a spouse's business considered marital property?

Divorce lawyer at Musilli Brennan Associates, PLLC
Generally, a business started or run during marriage is considered part of the marital estate. That said, the devil is always in the details. Engage an attorney.

I have a law office trying to collect a debt that is over 9 years old

Answered by attorney J. Allen Fiorletta
Divorce lawyer at The Fiorletta Law Group, PLLC
If you received a letter from the Court, and not a lawyer's office, it sounds like you have already been sued ro collect this debt. If you have been sued and do not defend the case, a judgment may be entered againat you for the amount they claim is owed, plus interest, their costs and attorneys fees. This judgment could also appear on your credit report for another 10 years. You should discuss the letter that you received with a lawyer in order to help determine exactly what is going on.
