You need to retain an attorney with expertise in military matters. Your situation illustrates a very complicated issue requiring an understanding of federal law and when federal law overrides state law and few state judges or lawyers fully understand that issue. Understanding what part of your disability severance pay might be considered marital property is not a simple question but that is a state law issue. Generally, the military authorities will not honor a state court's "freeze order", but you need the assistance of a lawyer to deal with the funds after the military pays it to you.

First things first: hire a lawyer. It's almost worth the investment to help you overcome difficulties like the one you mention. It is extremely unlikely that a divorce is held open for 5 years. In most counties in Wisconsin, if there is no movement in a case for a year, the judge proposes to dismiss the case, and gives the parties a specific time within which to act, or else the case will be dismissed. That your husband is in jail is not a very serious obstacle: he can waive his right to appear, or in many courts he can appear by a television feed. A good lawyer will help a lot.

Spousal support for a marriage under ten years in length may generally "not" be for longer than half the length of the marriage. For marriages of ten years or longer, it may be up to the life of the recipient, or remarriage. That would depend on a very long marriage, never had the spouse worked and has no job skills. Lots of variables, but think half the length of the marriage as a rule of thumb. This advice does not establish an attorney client relationship, which may only be established through a written agreement.
