Yes. No. In Idaho, as long as they are married, debt is considered to be community debt. Now, he may be able to make an argument that the debt is solely for her benefit, but I don't know if he would win that. As long as she keeps the inheritance in a separate account in her name only, it is not community property. He should really get divorced as soon as possible.

You father is not legally obligated to pay any of your college expenses. However, if your dad agrees to do such, make sure it is reduced to a written judgment that can be enforced.

Dad can move to a different state, resde there the required length of time to satisfy jurisdictional requirements, and file. Taking the minor children with him, however, would not be advised. That could lead to serious ramifications.
