You can proceed by way of default judgment after February 16; although that divorce will not be final for no less than six months and a day from the date he is served. There are additional disclosure requirements you can complete now in order to avoid delay of entry of judgment by that six month date. Self help clinics or a consultation with an attorney can help you with that paper works. Good luck.

You are making $50,000 a year, financial issues should not weigh on this. And of course the draft from the other attorney is one-sided, he represents your husband. Your attorney may be handling your case very well or he may not. If you are uncomfortable with him, you may always change attorneys. Just make sure that his fees are paid. Your new attorney will arrange to get your file from him.

Your first step, in prudent self-protection, is to consult an experienced family law attorney. Assuming you live in Wisconsin, the marital assets and debts are presumed to be split 50/50although there are lots of recognised reasons why the parties, or a court, may modify that proportion. If you are an owner of the house, your spouse can not turn you out of the house, except through a temporary order from a family court (or on a harassment injunction, which does not seem likely). In a divorce, you might very well be a candidate for maintenance (= 'alimony') both on a temporary and longer basis. You will probably have to seek work. But all of these matters are highly fact-driven. Find a good lawyer and discuss the whole situation with him or her.
