How can I have my husband pay for divorce?

default-avatar
Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
The question of whether or not your husband should pay some or all of your legal costs for the divorce must be decided by mutual agreement or by the judge if you can?t agree. If a judge has to decide, that will be the last decision he/she makes, after making decisions on all the other financial issues. There is no fixed or absolute rule on what the judge should do.

Will I be able to get part of my wife’s retirement if we were married in October 2010 and I retired in May 2003?

Not sure if I understand the question. If no divorce is involved and she dies, it depends on whether she participates in the Survivor Benefit Plan. If you are divorcing any distribution depends on the Judge.

Do I have to pay alimony if my spouse has been committing adultery?

Annette M Cox Sandoval
Answered by attorney Annette M Cox Sandoval (Unclaimed Profile)
Divorce lawyer at Cox Sandoval Law, PLLC
Arizona is a no fault state. Spousal maintenance (alimony) is not affected by wrongdoing such has adultery. You should consider consulting an attorney to determine whether you are at risk of having to pay spousal maintenance. It is based more on the parties' financial circumstances, the person's ability to support him or herself after a marriage, and sacrifices made during the marriage to the benefit of the community.
