I want to get a divorce, where do I turn to get it?

Answered by attorney Sukhraj Singh Pamma
Divorce lawyer at Pamma Law Firm
If you want to try it out on your own you can turn to the family law facilitator if one exists at your local court. A second alternative would be a family justice center if you have one locally. It is always a good idea to consult an attorney because they are the only ones who can give you legal advice. If you find that you can't afford an attorney, you can always try to find one willing to provide limited scope representation. This limits the role of the attorney and can usually end up saving the client money. Driving under the influence with the child in the car would probably be grounds for sole custody provided that you are able to prove it up in court.

How long does it take to get a divorce in each state?

No one is required to hire an attorney, you may represent yourself in court. However, you are still held to the same laws and rules. If you have not done your paperwork correctly, it will be rejected. You also may not know everything to include for your own benefit (meaning your papers would meet minimum legal standards, but might not be in your best interest). If you go forward on your own, do your research and get all the help you can from the self help center at your family court (they cannot give you legal advice, but can help you with the process and paperwork). In California, the MINIMUM time required before a divorce can be granted is six months and one day after the Respondent is properly served with a copy of the dissolution paperwork (which you previously filed at the court). This assumes everything runs smoothly, the two you are able to settle the case, and there are no set backs in the process.

Depending on other facts, most probably you will have to bring an action to evict her from your property.
