Yes your husband can file a divorce if you are 5 months pregnant. The place to file the divorce is Florida because that is where you last resided together as husband and wife. You will have to live in VA for the required amount of time in that state to be able to file a divorce, before you can file. If he does file, you will need to hire an attorney in FL.
