Your spouse might be entitled to a spousal portion of your pension due to your work during the marriage..So if you worked for 30 years and were married for 5.. think 5/30 (years of marriage/years of pension accrued) x 1/2 (spousal portion) x pension..

If your husband does not agree to pay your counsel fees, then you can make an application with the Court for your husband to pay them due to the large discrepancy in incomes. As far as your fee arrangement with your attorney goes, that is something you have to work out with your attorney. Some attorneys will agree to wait until the end of litigation to get paid out of the proceeds from equitable distribution. For example,if there is real property that is being sold or a retirement account that is going to be distributed.

The issue is how was the house paid for. If it was owned outright prior to marriage, then it is your husband's separate property and you likely have no interest in it. If he was making payments on it during marriage, then the community acquires an interest as part of the principal reduction payments and you are entitled to 50% of the community interest. You may also be eligible for spousal support.
