Is my spouse entitled to half of my 401K plan in a divorce?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
In Idaho she is entitled to (amount of 401k)*years of marriage/years of 401k. If you started the 401k after you got married, she entitle to one-half; if before, then the formula applies.

What should I do if I thought I was divorced but am not? How?

default-avatar
Answered by attorney Robert Andrew Michael Burns (Unclaimed Profile)
Divorce lawyer at Law Office of Robert Burns
You need a lawyer to determine what went wrong and to get the divorce entered retroactively to before your current "marriage"; otherwise, you'll current "marriage" is void and will have to be replaced with a post-divorce valid marriage.

What is the basis for buying out my husband's share of our house for a divorce?

Robert Joseph Merlin
Answered by attorney Robert Joseph Merlin (Unclaimed Profile)
Divorce lawyer at Robert J. Merlin, P.A.
I do not understand your question. Buying out his interest in the house is a financial issue, although there could be emotional ties to it as well. If you have children and they are mostly staying with you, Florida law presumes that it is in the children's best interest for them to continue living in the house. maybe you can use that argument.
