Is there an easy, inexpensive way to get a divorce? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)

Some lawyers practice a kind of mediation called 'collaborative divorce,' in which the lawyer is simply a mediator, and cannot represent either party. Needless to say, lawyers have different opinions about its efficacy. They can also just do a divorce on a 'do it yourself' basis. The courts actually have forms which people can use. However, trying hard to retain a skilled family law attorney for at least one of them is almost always a more prudent way to proceed: a lawyer can untangle lots of knots to simplify matters which do-it-yourselfers usually can not.

If I move out of the marital home, until a settlement can be reached, do I lose my rights to it?

No, you will not lose your rights to the marital home if you move out. But there are many more issues in a divorce which need to be either resolved by the parties or the court. You do need to retain an attorney because without one, you can get trampled upon.

Depends on the language in the Final Judgment. Have the document reviewed by an attorney ASAP. Sometimes DFAS takes the position a spouse has only one year to apply for some benefits.
