Can she ask for 50% of my military retirement?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
She can "ask" for anything but in most states she will only be entitled to up to 50% of the portion actually earned during the marriage - not 50% of the total unless you were married for 100% of your military service.

How long after I file for divorce will I receive something?

You don't provide enough information to understand the situation. But, you won't receive anything from a court - most of the information and documents concerning the current status of the case will be your spouse's responsibility to notify you. Except for those things that he is required to notify you about, it is your responsibility to keep up with the process and learn what you need to do on your own. You should consult an attorney to learn more about the process of handing the case.

How can I file a divorce to my wife who reside in the Philippines?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
You file the papers and you must have them personally served on her. Or, if she is agreeable you can send them to her by mail and she must sign an acknowledgment and receipt and return that to you to file with the court. If she is contesting the action she must file a response within 30 days. If she isn't contesting and agrees with the terms of your petition she can do nothing and you can file for default judgment.
