Can my wife’s lawyers file an injunction to have my military disability severance pay held for use to pay alimony?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
You need to retain an attorney with expertise in military matters. Your situation illustrates a very complicated issue requiring an understanding of federal law and when federal law overrides state law and few state judges or lawyers fully understand that issue. Understanding what part of your disability severance pay might be considered marital property is not a simple question but that is a state law issue. Generally, the military authorities will not honor a state court's "freeze order", but you need the assistance of a lawyer to deal with the funds after the military pays it to you.

Can my daughter receive child support without filing for divorce?

Answered by attorney Marcia J. Mavrides
Divorce lawyer at Mavrides Law
In order for her to have an enforceable child support orders, your daughter must file a legal action with the court. If she is married, it would be a complaint for divorce or a complaint for separate support.

Can my husband just kick me out of the house if he owns it?

Gary A. Russell
Answered by attorney Gary A. Russell (Unclaimed Profile)
Divorce lawyer at Clos, Russell & Wirth, P.C.
No. If your husband wants you to leave, he would have to formally evict you as if you were a tenant. That does not mean he may not try to force you out, by changing the locks while you are gone. You need to commence an action for either divorce or separation in order to obtain an order from the court protecting you in the event he should try to do so.
